SEASON 2022/2023 - CONDITIONS OF ISSUE
1 Definitions
1.1 In these Conditions the following words and phrases shall have the following meanings: -
"Season Ticket" means a Ticket issued to the supporter of the club to gain entry to all home league fixtures over the course of the 2022/2023 season.
"Conditions of Issue" means these terms and conditions governing the issue and use of a Ticket.
"Ground" means the football stadium hosting any of the Matches.
"Ground Regulations" means those ground regulations issued by the relevant Ground from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground (copies of which are enclosed).
"Match" means all or any of the following final ties: -
- Home League Fixtures.
"Ticket" means an electronic ticket (and/or any rights arising out of or in connection with that ticket) for admission to a Match.
"Terms & Conditions of Entry" means: -
- each of the rules and regulations of The Football Association and The Football League (the ‘EFL’)
- the Ground Regulations.
- the Conditions of Issue; and
- the Ticket.
"Ticket Conditions" means the terms linked on the E-Ticket/Email confirmation.
2 Issue of Tickets
2.1 The issue of a Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry and Ground Regulations
2.2 Season Tickets are for the use of supporters of the Club only. By purchasing a Season Ticket, you hereby warrant and represent that you are a supporter of the Club whose name is endorsed upon that Season Ticket.
2.3 By applying for a Ticket you warrant and represent that you are not subject to a club or court imposed banning order prohibiting your attendance at the relevant Match.
3 Admission to the Ground
3.1 Use of a Season Ticket constitutes acceptance of the Terms & Conditions of Entry and Ground Regulations.
3.2 A Season Ticket permits you to occupy at the relevant Match (but not otherwise) the seat indicated on that Season Ticket or such other alternative seat as Gillingham Football Club may allocate to you, acting reasonably.
3.3 You shall not bring into (or use within) the Ground any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to a Match or any aspect of it, including cameras.
3.4 Mobile telephones are permitted within the Ground, if they are used for personal and private use only. For the avoidance of doubt no material captured may be published or otherwise made available to any third parties including, without limitation, via social networking sites.
3.5 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use, or display within the Ground any sponsorship, promotional or marketing materials.
3.6 You shall not bring or attempt to bring into the Ground any alcoholic beverage whatsoever. Refreshment facilities will be made available inside the Ground.
3.7 You shall not offer (either free or for sale by any person) within the Ground any goods (including literature) of any nature without the express written permission of Gillingham Football Club.
3.8 There is no re-admission if you leave the Ground.
Gillingham Football Club reserves the right to refuse admission or eject from the Ground any person who fails to comply with the Terms & Conditions of Entry.
4 Non-transfers of Tickets
4.1 A Ticket is issued for your sole use, and you shall not resell or transfer any Ticket to any other person without the prior consent of Gillingham Football Club.
4.2 Without prejudice to the general wording set out in clause 1 above, no Ticket may:
(A) be used for any promotional purpose whatsoever (including, by way of example, in any competition, auction, give-away, or as a premium)
(B) transferred, lent, or sold to any third party as part of a hospitality or travel package unless you have the prior written consent from Gillingham Football Club.
4.3 All Tickets will always remain the property of the Gillingham Football Club and must be produced together with evidence of your identity if required to do so by any official, steward or employee of Gillingham Football Club, or any police officer. Gillingham Football Club reserves the right to retain any Ticket at any time.
4.4 Any Ticket transferred, obtained, or used in breach of the Terms & Conditions of Entry shall be void and all rights conferred or evidenced by the relevant Ticket shall be nullified. Misuse of a Ticket may result in the holder being ejected from the Ground and/or the cancellation and withdrawal of that Ticket. In the event of any cancellation and withdrawal in accordance with this clause 5, no refund shall be payable.
4.5 Gillingham Football Club further reserves its right to take any legal action against any appropriate persons as it sees fit in connection with such matters.
5 Changes to Dates, Refunds & Exchanges
5.1 No guarantees can be given by the Gillingham Football Club that the Match will take place at a particular time or on a particular date. Gillingham Football Club reserves the right to reschedule any Match without notice and without any liability whatsoever.
5.2 In the event of the postponement of a Match before you have entered the Ground and before kick-off, the Ticket will be valid for the rearranged playing of the Match.
5.3 Where a Match is postponed after you have entered the Ground, but before the Match has kicked-off, entry to the Ground for the re-arranged Match shall only be permitted on presentation of the ticket and subject to compliance with any other requirements announced by Gillingham Football Club at the time.
5.4 In the event that the Match is played ‘behind closed doors’ or the postponed or abandoned Match is: (i) not re-arranged; or (ii) the Ticket holder is unable to attend the rearranged Match, the Ticket holder will be entitled to a reallocation of the ticket to a home league fixture of the season that the fixture in mention is played. The procedure for such, will be announced by Gillingham Football Club.
5.5 In the event that the Ground reduces the intended capacity of the stadium after the date that Tickets were on sale, Gillingham Football Club reserve the right to cancel your Ticket and provide a reallocation of the Ticket to a future home league fixture
5.6 If you or anybody in your household is displaying COVID-19 symptoms (in accordance with official government guidance at the time) you must not attend the Ground and will be eligible for a reallocation of the Ticket to a future home league fixture.
5.7 This clause 5 sets out your sole entitlement in relation to the applicable circumstances set out. Gillingham Football Club will have no further liability whatsoever, including (but not limited to) any connected loss or damage, (for example, loss of enjoyment or accommodation or travel costs). No liability will be accepted for business losses
6 Lost, Stolen or Defaced Tickets
6.1 In order to gain admission to the Ground a Season Ticket or Ticket must be presented in its entirety at the Match. Defaced, illegible or incomplete Tickets may be invalidated. You are responsible for ensuring you keep your Ticket in a safe, secure and good condition.
7 Cancellation & Withdrawal of Ticket
7.1 Without limiting any other remedies it may have, Gillingham Football Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Ticket issued to you. In the event of such cancellation, you may be ejected from the Ground and no refund will be paid. By way of example, the following circumstances are considered by you and Gillingham Football Club to constitute serious breaches of the Terms & Conditions of Entry:
(A) smoking inside the ground, including e-cigarettes.
(B) persistent standing in seated areas whilst the Match is in progress.
(C) unauthorised sale or transfer of any Ticket to any person.
(D) deliberate misuse of any Ticket.
(E) failure to comply with all relevant statutes, safety announcements and other rules and regulations applicable whilst inside the Ground.
(F) behaviour likely to cause injury, nuisance or annoyance to yourself or others or damage to the Ground or any part thereof.
(G) any misrepresentation in relation to clause 2 or 2.3.
(H) taking into the Ground any unauthorised articles.
(I) the supply of any misleading or incorrect information in any application; and/or
(J) any failure to pay or default of payment in respect of any sums owing to Gillingham Football Club in respect of any Ticket.
7.2 In the event that your Ticket is withdrawn, or cancelled Gillingham Football Club reserves the right to exclude you from applying for any Match ticket at its discretion. Your name, identifying details and/or any photographs of you (including but not limited to any material being personal and/or special categories of personal data as defined under the General Data Protection Regulation (or any superseding legislation having effect in England)) may be passed to the police and/or such other appropriate authority as Gillingham Football Club sees fit.
8 COVID-19
8.1 In the event that you are displaying COVID-19 symptoms, or if anybody in your household is displaying COVID-19 symptoms, or if you are otherwise self-isolating (either due to a recent positive COVID-19 test or otherwise), please do not attend the Match. In these circumstances, you must inform Gillingham Football Club prior to the Match and subject to you having done that you will be entitled to a reallocation of your ticket. The reallocated ticket will be only effective to use for that current season.
8.2 Gillingham Football Club are committed to as far as possible ensuring the health and safety of spectators, and to providing as safe and suitable an environment as possible during this COVID-19 pandemic. To ensure this, all spectators must behave in a safe and responsible manner at all times. By purchasing a ticket for a Match, you are agreeing to comply with Gillingham Football Clubs’ COVID-19 Spectator Code of Conduct (including, amongst other things, the ‘track and trace’ measures within the Code of Conduct). Please be aware that Tickets will not be released and attendance at the Ground will not be permitted until all relevant ‘track and trace’ information has been provided in accordance with the Code of Conduct. 8.3 You must also comply with any other instructions in relation to COVID-19 which may be provided by the EFL and/or Club after you purchase your Ticket(s), for example, to account for updated government guidance or other changes in circumstances as the pandemic develops.
9 Personal Data & Filming
9.1 By entering the Ground, all persons are acknowledging that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom ) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by the Club, the EFL or others (including commercial partners and accredited media organisations) and entry into the Ground constitutes your acknowledgement of such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of the Terms & Conditions of Entry.
10 Exclusion of Liability
10.1 To the maximum extent permitted by law, Gillingham Football Club hereby exclude any liability for loss, injury, or damage to persons/property in or around the Ground.
11 Governing Law
11.1 These Conditions of Issue shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.
Gillingham Football Club Customer Charter
Gillingham FC accept no responsibility to replace lost, damaged, or stolen tickets.
Spectators found in the wrong area amid opposing fans may be ejected by the police.
The use of a ticket to enter the ground constitutes acceptance of the Ground Regulations and Gillingham FC reserves the right to eject from the stadium, any person who fails to comply with such rules and regulations.
Holders of Concessionary tickets may be required to produce evidence of entitlement.
MEMS Priestfield Stadium is a no smoking stadium. Vaping is also not permitted.
